Abstract

The cycle of two web conference on cloud computing aims to show the status of the development of cloud computing solutions in Italy, describing the concrete experiences of some of the leading ICT players in the Italian market and through the involvement of legal and technical specialists.

The first web conference is on the subject of  “Technical aspects, legal and personal data protection in the cloud computing systems“, meanwhile, the other web conference focuses on “Cloud Solutions for Public Authorities: IT security, legal and data protection personal “(14 June 2012).

The new paradigm proposed by cloud computing providers will be dealt with, in particular, the data protection approach, illustrating the problems related to data protection law and information security  in a cloud environment. Technical issues such as interoperability of cloud computing systems and the need for the adoption of technical standards will be addressed.

Then there will be an analysis of the most common legal issues of the “Cloud”: what are the security measures and legal requirements relating to the protection of personal information to create a cloud computing system compliant with Community law / international and Italian? What are the main problems in terms of contracts? What happens when there is a breach of service level agreements and what precautions are necessary? During the event other critical issues will be analysed: the data portability, data interoperability, the sever location, encryption and anonymity.

Lastly,  the following questions will be also analysed: Who is the owner of the personal data in the cloud computing systems and what are its main responsibilities, in particular, in a context of the chains of responsibility in the veriaty of cloud service providers? What are the issues related to the ownership of the exploitation rights of the software system used between the cloud service provider and the customer? What are the issues related to the know-how and industrial property rights of the information managed in the cloud computing system?
